Lecturers'
Rights in the Current Contract The contract retains, and in some instances clarifies or enhances, previously bargained lecturer rights. Explained here are some new or modified provisions from the 2006-2010 Contract. Art. 10, Grievances: In addition to the contractual process, faculty may now grieve through a statutory process which includes a hearing before a faculty panel. Lecturers also have the option of appealing to an Article 12 Umpire in cases relating to appointment, reappointment, work assignments, and careful consideration. The umpire will schedule a hearing within 30 days and render a decision within 3 days of the hearing. This new procedure finally recognizes that when justice is delayed, it is also denied. All lecturers can vote in faculty panel elections, and full-time lecturers are eligible to serve as panel members. Art. 12, Appointment: If a class assigned to a lecturer is cancelled after the third class meeting, the University is required to pay the lecturer for the remaining portion of the class assignment or provide an alternate assignment. Three-year appointments are automatic except in cases of documented unsatisfactory performance or serious conduct problems. There shall be no special or separate evaluation required, since it is expected that lecturers will be regularly evaluated during the 6-year period preceding eligibility for a 3-year appointment. Even in cases where there is no work to meet the time base entitlement, lecturers will maintain their entitlement for the duration of the three years (even at a zero time base). If at the end of the three years, there is no work or the time base is zero, the lecturer has special recall rights for a period of three years. Art. 15, Evaluation: Class room visits for the purpose of evaluation require notification and consultation. For lecturers on 3-year appointments, a periodic evaluation is required only once during the three year term, unless the lecturer or the administration requests an additional evaluation. Art. 21, Summer Term: The CBA establishes contractual procedures and a hiring order for summer term. There is a lecturer benefits stipend for summer term. Art. 31, Salary: Lecturers are on the same salary schedule as tenure-line faculty, except for Range A, which is only for lecturers. Lecturers receive the same percentage General Salary Increases (GSIs) and Service Salary Increases (SSIs). See www.calfac.org/contract.html for detailed information on upcoming raises. Lecturers in Range D are now eligible for Post Promotion Increases. Finally, an important reminder: Lecturers are Faculty! Part-time and full-time lecturers are faculty employees in Unit 3 and are covered by all references in the contract to “faculty” unless specifically excluded.
